Liability Waiver & Release

This Liability Waiver and Release of Claims ("Waiver") is between you ("Client") and Higher Heights Fitness, its owner, coaches, employees, and contractors ("HHF"). By checking the acceptance box on the Join page, or by otherwise enrolling in or using HHF's online coaching services, you agree to the terms below.

1. Assumption of Risk

Exercise, strength training, and physical activity carry an inherent risk of injury, including but not limited to muscle strain, joint injury, cardiovascular events, and in rare cases, serious injury or death. You confirm that you are voluntarily participating in HHF's coaching program with full knowledge of these risks, and that you are physically fit to participate or have consulted a physician about any condition that might affect your ability to do so.

2. Medical Disclaimer

HHF coaching is not medical advice, physical therapy, or a substitute for care from a licensed physician. Programming, nutrition guidance, and check-in feedback are provided for general fitness purposes only. If you have a pre-existing medical condition, injury, or are pregnant, you should get clearance from a physician before beginning or continuing this program. Stop any exercise immediately and seek medical attention if you experience pain, dizziness, chest discomfort, or shortness of breath.

3. Release of Liability

To the fullest extent permitted by law, you release, waive, and discharge HHF from any and all liability, claims, demands, or causes of action arising out of ordinary negligence in connection with your participation in HHF's coaching services — including injury, loss, or damage to you or your property. This release does not apply to, and nothing in this Waiver limits liability for, gross negligence, recklessness, or intentional misconduct on the part of HHF.

4. Your Responsibility

You are responsible for using safe judgment during workouts, including selecting appropriate loads, using proper equipment, and stopping when something feels wrong. You agree to communicate honestly with your coach about pain, injury, medical changes, and how exercises actually feel so your program can be adjusted appropriately.

5. Electronic Signature

By checking the acceptance box during signup, you are providing your electronic signature and agreeing that it carries the same legal weight as a handwritten signature. HHF records the date, time, and version of this Waiver you accepted.

6. Governing Law

This Waiver is governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
